Section 54

Hi, I have computed the capital gain on sale of residential house property . Transfer date is 06.02.2013 Capital gain Rs.50,43,200 On 07.06.2013 client made investment in new residential property of Rs .80,00,000 out of this investment 50% belongs to spouse . but for avoiding vat ,sale deed registered only for Rs .20,00,000 How much I can get deduction under section 54 .

Hi, How to account stock transfer in tally Erp9.

hey,
if a school has made an advance payment of Rs 400000 to Great India Nautanki Co. Pvt Ltd for students to see kingdom of dream show and school made the balance amount of Rs 175000 after the show, so will tds be deducted while making these payment?
If yes, under which section and why?
If no, why?
Please suggest

Tds under sec 194c

One of our client is running rice mill in the Ass.Year 2009-2010 he hired truck from the Subcontractor having two trucks, the client could not deduct TDS by applying circular No. 3/2006 Dated 27.02.2006 & by following the provisions of sec.194(c) subsection 3, However the Assessing Officer disallowance the claim on the basis that our client is not contractor engaged in Business of plying, Hiring, leasing goods carriage infact he is rice miller. Our client has complied for all the formalities like for 15-I, 15-J. Our question is –
(1) Under Sec. 194C whether the contractor includes our client who is proprietary from & Rice Miller. If Yes, then how & why.
(2) Whether our contractor is correct that under subsection 3 of 194C, Our client is not required to deduct Tax at source.

Section 54f

If a person gets capital gain on sale of plot & Invest whole of the capital gain for purchasing a residential house.But He does not have sufficient fund for purchase the residential house. My question is ......can he jointly held the property with their son or not ?

Form f under cst act/ rules

If consignment has been sent/ despatched during Sep13 on Stock Transfer basis but the same has been received by branch office/ consignment agent during Oct13.

Kindly advise whether form F should be treated in Sep13 or Oct13.

Partners salary

Dear Sir/madam
for computing gross total income, is salary received by partner from partnership firm is adjusted by other business loss carried by partner because of partner salary charge ability section 28.

Section 54ec and 54f

have a query regarding section 54ec and 54f under the head capital gains in income tax act. assessee had sold his land at 7742616/- and derived a capital gain of 6741397/- and sold his office building at 309000/- and derived a capital loss of 248055/-. hence net long term capital gain of Rs. 6493342/-. assessee has reinvested in flat amounted Rs.1080073/-. and claimed exemption of Rs.940405/- u/s 54f as (1080073*6741397)/7742616 but dept had accepting the claim of Rs 871040/- as (1080073*6493342)/8051616 applying net consideration system. kindly suggest me case laws regarding this matter in favour of assessee.
