I would like to know that if company availed deposits from partnership firm under which only one partner is relative .. thn is it violation of 58 -A Company's act or not? I have confusion regarding the same.

For how long could there be a vacancy in the office of the auditor in a private limited company?

Facts are that auditor had resigned from office. How much time is there with the board to fill the vacancy by calling an EGM???

As clause (g) of sub-section (1) of section 274 of the Act is not applicable for a private limited company, can it (point no. : 2(e)) be removed from the audit report or shall the same remain as a point in the report & comment be given as "This clause is not applicable for a private limited company".

Can a draft statutory auditors report for FY be considered in the audit committee meeting held for recommendation of financials to Board.

A company has filed form1a.The director who has certified the form1a has resigned prior to preparation and upload of form 1,18 &32. So should he be included in the MOA and AOA and what is the procedure to be followed for removing him

Suppose notice of AGM is short. No form 22 is obtained by the Company. The auditor carries out his duties without being aware that his appointment is defective. The fees that he has received from his client, would it constitute indebtedness,since his appointment is defective.
