Service tax on road transport

We are exporters.
"X" is our forwarder. He hires "Y" to transport container by road from our factory to the port.
"Y" issues GC note in our name.
"X" gives us comprehensive bill for all his services. One of the billing item is "transportation from factory to port"
"X" charges us 12.36% ST on this transportation.
His claim is that he is not GTA but a forwarder, hence there is no abatement.
Please guide me.

Negative list

when composite service provided "providing space for advertisement and designong of advertisement" one is under negative list and other one is taxable" Thanks......

sir i submitted ST-1 form mentioning only one signatory of private ltd co. but it is said we should mention all directors' names.
so sir please tell me how should i rectify the mistake?

Service tax credit

If we registered under Excise but not registered under service tax, So, please advise can we take Service tax(received on profession service) credit in central excise.

Service tax on rent by service receiver

Our co. is giving monthly rent of Rs.10000 to the director and co.is filing service tax return as service receiver...
Clarification given to me by taxation manager is:-
''As director's turnover of rent is not crossing the taxable limits so co.is under obligation to take registration and to pay tax and to file return as service receiver.
In my opinion this is quite wrong and moreover this service doesnt come under reverse charge so no service tax is payable by co.

Service tax liability

Our co.is receiving transport services from A Ltd.say for Rs.1000 in this case co.is supposed to pay service tax under reverse charge mechanism and this Freight amount is revoered from B Ltd.our customer as Rs.1200 so on which amiut co.is supposed to pay service tax on Rs.1000 or rs.1200

When does service tax become applicable

Hi,

I have a proprietorship firm handling recruitments. I wanted to know when does service tax become applicable. My last years turnover was 2L and this year has reached 8L. Do I have to charge service tax now or will it become applicable when I cross 10L this year. kindly advice

Late filing

We forgot to file the service tax return within the due date, we are going to file the return on tomorrow(15-11-2013). What will be the penalty for late filing of this return.
