sujit nayak

Dear Learned members,

I have a query related to notification 12/2005 dtd.19/04/2005.

Subject:

A 100% EOU is exporting services and claiming rebate for the duty paid inputs, especially utilized towards such export. For a particular financial year the branch company of such 100% EOU made indigenous sale and paid service tax of its output.

While filling the return (ST-3) the assessee claimed Cenvat credit for the duty paid inputs utilized towards such indigenous sale and the same time claimed rebate for the duty paid inputs used towards such export.

Query: I would request the learned group to guide me with citing any case law, if the assesee's claim stands for.

Awaiting for an early response.

Thanks, Sujit Nayak

Applicability of service tax

There is one project for which my company is incurring cost (including hiring employees specifically for that project), but the same will be billed by parent co. to client. My co. will in turn raise a bill on parent company for reimbursement of expenses incurred on that project. Will service tax be applicable on that bill raised for reimbursement of expenses to parent co.

Gta-accounting code & interest.

Dear Sir / Madam,

please guide us for GTA service Tax Payment Accounting code & Interest calculation. as per below example.

Transport Charges Rs.10000/-
Taxable Amt. Rs.2500/- (25% of Rs.10000/-)
Basic S T Rs.300/- (12% on Rs.2500/-)
Edu. cess Rs.6/- (2% on Rs.300/-)
H.Ed.Cess Rs.3/- (1% on Rs.300/-)

then we have calculate interest Amt. on Rs.300+6+3=309/-@18% as per delay days. Is it right ?
OR
we have calculate interest amount separately on each item as Rs.300/-, Rs.6/- & Rs.3/- ???

and tell us accounting code for above.
Thanks in advance.

Regards,

Rajendra

Work contract service

We would like to seek your opinion in the following case :-
“If a work order is awarded for electrical repair work – to an individual, comprising purely labour charges say Rs.1000/- (material has been provided by the Service Receiver) and in the other part for supply and labour charges say Rs.2000/-. In this case, Work Contract Service will be applicable on the second part only or the entire bill.

Service Receiver would be liable to pay 50% of the service tax i.e.,70% of 2000*12.36% .

Sweta Kalantri

A company has reimbursed servicing and repairing charges of vehicles claimed by the employees of the company. servicing and repairing of movable property would be treated as works contract (vat and service tax both are charged). now my query is will reverse charge be applicable to the company for these reimbursements to the employees?
