X & Y are running company at present filing all documents, annual returns at ROC ( EXCEPT in one year-2005 - Annual Return was not filed)
BOTH COMPANY X & Y are using Bank Finance.
Z company – business was closed but ROC documents was not filed after closure - either not for closing and not for regular annual returns etc.
Now as company X & Y are using bank finance they have to file ROC FORM-8 for creation/modification of charge. But as Director A & B are also director in Company-Z (being Defaulter company) – company X & Y could not modify charge due to lack of signing authority ….
What should be done for filing Form-8 ?????
