Payment of gratuity act,1972

As per section 4, gratutity is payable to employees after 5 years of continuous employment. However this continuous period of 5 years is not applicable in case of termination of employment of employee due to death/disablement.
Section 4 (2) quotes the following "For every completed year of service or part thereof in excess of six months, the employer shall pay gratuity to an employee at the rate of fifteen days wages based on the rate of wages last drawn by the employee concerned"


Kindly suggest at what rate the gratuity, would be payable to an employee whose employment is terminated due to death and when the employee has not completed six months of service in the organisation?

can ca practising refuse to provide the information submitted in the ITR form on behalf of the client, & client has request to provide the same ITR, CAN DEMAND OF CLENT IS GENUIE?

CAN CA refuse to provide the copy of the same ITR form?

Power of attorney

I am working as a full-time Co. Secy. in a Ltd. Company on contractual basis and drawing professional fees on monthly basis.Organisation is deducting TDS against my fees.Will it be necessary for me to obtain registration under the Service Tax Act? If I obtain the above registration, shall I get any extra benefit while calculating my taxable income under the Income Tax Act?

Friends I have appeared in may 2012 ipcc exam. In law I was expended a minimum of 60-65 marks but I got only 35. So I was shocked to see that. Now I want to ask u guys how to write well in law paper coz I was prepaired well but got nothing. What should I do. ....?

HI..IAM AN IPCC STUDENT, I HAD PREPARED VERY HARD FOR MAY 2012 BUT I GOT FAILED IN LAW AND ITS BECAUSE OF LAW I FAILED IN MY NOV. 2011 ATTEMPT ALSO...I DON'T KNOW HOW TO PREPARE MYSELF FOR THIS THEORY SUBJECT AS NOW IT LOOKS MORE DIFFICULT. Dear Experts

Co. A has an overseas 100% subsidiary B and B has a 100% subsidiary C.

Now can A directly invest, extend loan, issue guarantee, security to C...

can C be termed as A's wholly owned subsidiary for 295 and 372A.

from the point of view of sec. 372A & 295..... wholly owned subsidiaries are outside the purview of both 295 & 372A.
