Customs

Our company is into Trading . Basically, we import material from our parent company in Italy and sell these finished goods in India. We pay customs duty for the imports. If we want to return this material or export the same to another country,
1) is there any custom duty applicable
2)Can we claim refund on the earlier duty paid
3) What would be the procedure to claim refunds, please

custom duty

we are importing the goods and sale such goods India. One of our client in india told us not to include custome duty in purchase cost receive duty back from custom department and charge vat on net cost plus profit.
For ex we charge vat on Rs 125 (100(cost)+10 (custom duty)+15(profit))
as per client Rs 115 (100(cost)+15(profit)) and receive Rs 10 from custome deptment.
Which tratment is right?

High Sea Sale aggrement

Export Sales or Stock

One of my client is engaged in exports. He has sent one shipment of Rs.480000 on 19-03-2010. But due to strike by British Airways his goods are lying at the warehouse of his cargo agent. He has not got the custom bill. During all this the financial year has changed from 2009-10 to 2010-11.

Kindly tell whether it shall be considered as export sales or stock.

Custom Calculation

Can any one guide me regarding custom calculation?

We had purchased an medical instrument in 1991 & its assessable value was Rs. 777555/-

They charged BCD 60%+Auxiliary duty 50% + CVD 15% + 10% Special Central Excise duty
=855311

I want know the break-up on above

1. We will receive major RM from party & will use some other input like nut bolt, etc.

After completion of process, what will be the value of final goods to raise invoice?
1. whether only value addition + labour+ profit

or
2. the value of RM supplied also to be include ?.

pls claify with relavent provision of not or circular.

dear sir,

we are exporter of automobile lighting . we want to import BMC Mould from taiwan without bringing the goods to indian port. is it possible? if yes, then how can we do have to take any prior permission from any government authority for this?
