Dear Members,
As per the recent budget amendment, there is no Education Cess or Secondary and Higher Education Cess applicable on CVD.
My doubt is, in case Basic Customs Duty is Nil, but CVD is applicable (i.e. 12%), education cess has to be charged on the total duty (i.e. on BCD + CVD)?
Let me explain my doubt with example:
Assessable Value : 100
BCD : NIL
CVD : 12% (No Cess Included)i.e Rs.12
Customs educ cess : (2% on BCD+CVD)i.e Rs.2.24
CustomsS&h Edu cess : (1% on BCD+CVd) i.e Rs.1.12
My doubt is whether i can take cenvat credit i.e Rs. 2.24 and Rs. 1.12 kindly clarify
regards
ravindra

Some question ,, Please Give ans urgenty !!
Q.1 Are Export of fabrics made product free from duty?
Q.2 If no , what is the rate of duty for export textiles materils ?
Q.3 Are rate of export duty differ countr to counrty ? ( we want export fabric made item to USA and Itly )
Q. what documents are need to attached along with the consignment ?
Q Is there any export incentive on export?
Normally, exports are made
in US Dollars/Euro/Sterling Pounds, etc. Some consultants in the field of textile exports are now suggesting that exports, even to non-Asia Clearing Union countries such as UK and Japan, can be made in Indian Rupees! This necessarily entails that:
1) Invoices will be in Indian Rupees
2) Customs shipping bills will be in Indian Rupees
3) G.R.Forms will be in Indian Rupees
Is this really possible and allowed? Can anyone guide me to some written reference, policy notification, etc. which confirms that exports in Rupees are freely allowed by the Indian Government?
Can we claim duty drawback against such exports in Indian Rupees?Again, I request that you suggest some written reference material or notification confirming this.
The AGRA CORP, one of our suppliers quoted the price for Australian White Wheat USD 295/- per MT (Bulk) FOB-Australia & payment term as 100% site LC. What are the factor you will take into consideration to get the Final cost ?
Thanks in Advance.

Advance license was issued in 1995 and EO was also made by the licensee. The firm closed in 1998. Now in 2011, the firm was issued SCN asking for the EO Compliance details.
Defaulter order has also been pasted outside
the premises of the proprietor of the firm.
a) What is the time-limit of keeping EO
records by licensee ?
b) Is there any time-limit for issuing
SCN after non-compliance of EO ?
c) Suggest the course of action.
