Capital Input

Dear Experts,

We are Coal Mining Co. and w.e.f 01.03.2011 we comes under the purview of Central Excise. Our Duty Deposit is more than One Crore monthly.

Sir, we are using heavy earth moving machinery like Dumper/Tippers, Pay Loaders, Shovels etc. and these Vehicles are exclusively used in mines for the production of Coal. Now my question is that can these Vehicles and the spares purchased for these Vehicles comes under Capital Goods and the Excise paid on the purchase of these Vehicles/Spares can be taken as Capital Input.

So far as I have understood that the Capital Input on Dumpers/Tippers(under Chapter 87 w.e.f 22.06.2010) are only available for output service provider involved in Mining of minerals and we are manufacturer so we cannot use capital input even if we are exclusively using these vehicles for coal production. However, I have not found any information regarding the other vehicles like Pay loader & Shovels. Will these vehicles qualify for Capital Goods?

Moreover, what are the returns which we have to file Monthly & Annually.

DEALER'S RETURN

our client has imported certain goods during the month of Jan to March on which he has paid BCD, CVD of and addl duty of excise. Our client is a dealer. However he has not made any sales guring the quarter. my question is that, as he has not made any sales does he have to file a "NIL" quarterly return, or the return has to contain details of duty paid on imported goods?

Issue of Excise Invoice

X, a foreign Co. in Korea, a manufacturer of accessories of machinery.
Y, its Subsidairy in India, imports Goods from X Co. for sale of the same to its Distributors in India without any modification.
Can Y Co. issue Excise Invoice to its distributors?????

Cenvat Invoices Lost By Fire

Last Maonth our unit was burn by fire in it our many bill lost by fire can any procedure to take cenvat credit taken pls guide us.

excise duty refund procedure

CAN I GET THE FULL REFUND OF EXCISE DUTY IF I MADE THE SALE TO EXPORTER & HE EXPORTS THE GOODS AFTER PROCESSING ? I AM SUPPLYING HIM S.G IRON CASTING & HE IS EXPORTING VICES

Tariff Codes

Sir I want to apply for excise registration. I am engaged in assembling. I am confused about the tariff codes to be mentioned in online application. I know these are covered under chapter 72. But confused about sub codes. Please help me.
My purchase consists of: Ferrous & Non Ferrous Metals, M. S. Bar, Steel Forging, Engg. Goods, Bearings.

Assembled Product consists of: Roller, Pully, Roller Bearing, Bar Hinges (kabje)


Please tell codes of both purchased products as well as assembled products.

I wish to know that unit of measurement mentioned in Central Excise Tarrif are mandaory or nor. Suppose Chaper Heading 9032 90 00 unit of Measurement is defined in KG as per tarrif. But infact this is a smal product and can't be procured in KG. It will be procured in unit.
Is this to be procured in KG mandatory as per excise rule? also provide some references.

Non Assessee Form

Sir in which cases Non Assessee Form for Registration of Excise is required?

Actually assessee is opening new business, he wish to assemble the purchased products and his sale will also constitute export. But his total clearance will be less than Rs.1.5 crores. To Claim benefit of excise paid on purchase he wants excise number.

So should he fill Form A-1 for registration or Non Assessee Form?
