30 May 2011 X, a foreign Co. in Korea, a manufacturer of accessories of machinery.
Y, its Subsidairy in India, imports Goods from X Co. for sale of the same to its Distributors in India without any modification.
Can Y Co. issue Excise Invoice to its distributors?????

30 May 2011 Invoice is compulsory ion every business, but in case of any manufacturing process are not taken place than the excise duty can not be imposed. The goods are chargeable to excise only in case production process are carried out.

30 May 2011 In the above case Y has paid the custom duty.He is not processing it further then can he pass on the benefit to its distributors????

30 May 2011 in case of imported goods, Y has to get himself registered under excise as dealer, and he can pass the CVD portion to his distributors, buyers, under as dealers capacity.

01 June 2011 Pls note that Y is not a manufacturer. Can he still pass on the benefit?

01 June 2011 yes Y can pass the CVD by getting registered as "excise dealer" with excise department.
