Modvat

We are a manufacturing company sold goods to a trader who doesn't have excise registration and do not avail excise benefit. The said trader after 3 month returned the said material but we have already paid the excise duty for the said sale. Now I would like to know how or what shall be the procedure to return the material so that we can take the benefit of the excise already paid.Early response shall be highly solicited.

Is any body there to help me out.

Levy of excise duty on labour charges

Dear sir,
A manufacturing concern duly registered in excise providing after sales service to his customer on their site , while issuing invoice they charged excise duty on labour charges instead of charging service tax , but fact is that the concern is not eligible for service tax registration . in that case charging excise duty on labour charges is viable??
Please guide me.
Thanks in advance !
