The supplier assessee issued invoice in respect of consignee 'X', showing the delivery at consignee's sister concern 'Y' factory. 'X' lifted the goods (input) by his pick van from 'Y's premise under delivery challan issued by 'Y'. Is it a technically correct arrangement? Can 'X' now take CENVAT? Should Assistant Commissioner be informed beforehand about storage of inputs outside factory?

Cenvat Credit

A Assessee purchased/Import a machines for manufacturing purpose. But a incident held after one month of it purchased and machine burnt totaly after its installation. Then what will be the procedure for the 50% credit taken. Is it will be reversed or credit will be admissible.

What is the procedure of sales return in diffrent cases :
1.Party is a Manufactuter cum exporter dispatched goods as a direct sale
2.Party is a Manufactuter cum exporter dispatched goods to stockyard for sale
3.Party is a Manufacturer cum Merchant exporter dispatched goods to stockyard for sale
4.Party is a Manufacturer cum Merchant exporter dispatched goods for export

how to do excise audit

hello sir, from tmmrw i going to start exicse audit at bhiwadi.the company is manufacturing AC foils and also other parts of AC. i m doing this type of audit 1st time. so plz suggest me some important point and tips so that i can do that audit in a better way as i m doing this type of audit for 1st time.

Assessable value

Dear Experts,

Pls contribute to the following:

A Co mfg. final product for railway which was earlier ( before budget 2011) was exempted from Excise duty.

From budget 2011 the product fall under 1% excise duty as applicable.

Railway has been supplying steel for the mgf of final product free of cost(or reimbursable).

Now my question is after budget 2011, what will be the assessable value of the product, i..e, including the cost of steel or just actual cost?

Third Party Export

I am working as Senior Accounts in a mold manufacturing company(Domestic), recently we have encounter an a issue regarding with Export of mold where details as follows

We have received an order for mold from UK Company which residing and operations in UK only, we have accepted the order. Due to technical reasons we processed the mold in CHINA by third party, now we want to dispatch mold to UK from China and raising the invoice by us In(INDIA).

Regarding above said we have following issues

1.Is it right way to export the mold from China to UK and raising invoice in India.

2. If it is right what are the procedures and documents should made as per customs & Excise.

3. if it is wrong what exactly we have to follow.

We are registered under Central Excise as manufacturer.

We have balance of CENVAT Credit of Basic Excise duty, but no credit balance is available in respect of Ed. Cess and S.Ed Cess.

My question is, whether the CENVAT Credit of Basic Excise duty be get utilized for payment of Ed. Cess and S.Ed Cess on the final products u/r 3 of CENVAT Credit rules?

what's the assessable value ?
should it deals as dealer sale while we are manufacturer?
should i Deduct depreciation for find our assessable value?

Excise set off

I have recently started a company dealing in industrial tools and components in Pune and have a VAT number. Some companies from whom I purchase material charge excise duty. As my company is not under excise, I can not avail the excise cerdit or charge excise to my customers.
What am I supposed to do in this case? Is it possible to register my company under central excise as I do not have a manufacturing unit. If yes. what is the criteria?
