Ay 11-12 roi filed on feb 12-itr v not yet submitted- sol ?

03 October 2013 Hello everyone,

Mr. X has filed his inc tax return for ay 11-12 on 20/02/2012. (belated return)

but till date he has not sent the ITRV copy to CPC bangalore.

Now date for submitting ITRV has already expired and since the return is filed after due date revision is also not possible.

Now when i am trying to upload the return as original return then also it is not accepted but revised return is accepted which is technically incorrect.

what is the solution ?

03 October 2013 If the revise return is due to the non submission of ITR-V with in the time allowed in such case revise return also accepted and processed by CPC even though the original return is belated it my own experience for some of our clients we faced the same problem and we filed revised return and submitted revised return's ITR-V CPC accepted and completed process and received Refund also and some of the practical cases CPC has suggested file revise return for the same issue, my friend directly talked with CPC for the same issue and CPC suggested file revise return.

As per the section 139(4) revise return shall be file with in the due date u/s 139(5) so according to this for your case the revised return filing due date is 31-3-2013,but you filed it after 31-3-2013 so i can't say what is the CPC's decision in this regards, because of as per the act your return in invalid and doesn't considered as return filed.

Any way if you already filed Revised return then submit ITR-V to CPC and wait for the CPC response, if not filed then contact e-filing administrator for suggestion what to do or forget about that year's return

I have yet not filed the revised return. i will try to revise now if it is accepted and wait and watch for response from CPC.
