Arrears of Salary

28 July 2009 Hello,

A wife has received Salary arrears of his late husband. Employer deduct TDS on arrears of salary. My Queries are:

1) Is it taxable in wife's hands?

2) can she claim refund?

3) is there any Rebate?

The Other income of Wife is 140000 Rs for the A.Y. 2009-10.

Plz it's urgent because last date of written filing is 31st.

29 July 2009 If there is any evidence to prove that there has been an error in the tax deducted at source the wife can file a return on behalf of the deceased in representative capacity and make necessary claim in that behalf. The return of the wife will continue to be filed seperately.
