Applicability of section 195

06 June 2015 Dear All greetings,

As per section 195 of the income tax act if we have to deduct TDS on any payment made to a foreigner.
My query is that if I pay the sum which is "an income not accrue or arise in India" then am I liable to deduct TDS thereon u/s 195?

06 June 2015 No TDS under section 195 be made provided the payment is not taxable in India.

Sir, just to confirm; does the following income paid by indian assesse fulfill the criteria of 'income accrue or arise in India' or not:
"freight payment made to the trucking agency situated in china to truck the goods from Chaina to Hongkong"

pls confirm sir,
