Company has imported software with pre-loaded on hardware weather TDS u/s 194J is applicable on pre-loaded software..And also if there is a Annual Maintanance Contract for software then what is the tax implication.. As per recent amendment royalty include software payment and also include licence but What about AMC for software??

TDS not applicable on pre loaded or off the shelf sowtware. Its applicable only when software specially customized to meet the requirement of client.
