31 July 2010 Dear Experts,
An Assesse does the following transactions in shares. Please tell me under which head i have to show his income.

1) Purchases and sells shares after holding
it for less than a year.
2) Keeps certain shares for more than
a year and sells certain shares.
3) Also makes intra day transactions (i.e.
Purchases & Sells the shares in the same
day)
4) Also does derivative transactions (i.e.
Purchases and sells Futures and Options
Transactions.)
5) Please provide me the section and related case laws available.

01 August 2010 intra day trading shall be speculative income

futures and options shall be business income

and share trading wil be depending on the volume. if it the volume is huge then it would be business or else capital gain
