28 July 2015 What is difference between Vehicle Owner and Transporter

If Transporter getting vehciles from vehicle owner and arranging vehicle to a company, then who will issue the declaration for non deduction TDS owner or Transporter. In this case, contract is between company and Transporter and Transporter is issuing LR.

28 July 2015 Only vehicle owners can issue declaration for non deduction of TDS. In this case transporter can't issue declaration hence TDS applicable.

16 January 2016 In case of a Transporter having 4 vehicles and issuing declaration for non deduction of TDS. He also arranges vehicles from out side, then TDS is be deducted or not.

17 January 2016 If he is hiring the vehicles then TDS applicable. TDS declaration can be issued by only Assesses eligible for assessment u/s 44AE.

One more question in this regards, some of them is issuing declaration stating that they are eligible u/s 44AE even though they have only less than 10 vehicles but arranges vehicles from out side.

18 January 2016 44AE applicable only to persons owning the trucks. The declaration is issued wrongly.
