15 February 2013 SIR,

IF ONE TEACHER IS SALARIED AND HE HAS ALSO INCOME FROM HIS OWN TUTION CLASSES. WHICH TYPE OF ITR SHOULD BE FILED WITH HIM ? MOREOVER, SHOULD HIS EMPLOYER MAKE T.D.S ON SUCH TUTION INCOME IF HIS SALARY PAID BY THE EMPLOYER IS LESS THAN 2 LACS BUT TOTAL INCOME IS MORE THAN 2 LACS. PLEASEGUIDE.

THANKS FOR GIVING REPLY(Mr.BAFNA and MR.NIKHIL). But if other income is given from his profession. Should he be allowed to deduct expenses incurred for his business and then net income be given as " other income " to the present employer for making tds from salary. And which ITR 4s ?

15 February 2013 Tuition Income fro own tuition classes is covered under the head of PGBP.
.
An employee has to provide declaration about his other income, and as such employer has to deduct TDS in case the Total Income of the employee exceeds the Taxable Limit.

15 February 2013 1. Please make sure that the said teacher is not violating his/her terms of employment by giving private tuition.

2. If the answer to statement is a NO, then the said teacher may declare the income from tuition to his/her employer and the employer can then deduct appropriate taxes.

3. ITR4 should be used for return filing.

16 February 2013 Dear anonymous author,

please note that the employer is neither supposed to compute your income from business and profession nor he/she is required to verify the veracity of the information provided to him/her.

So whatever information you may submit, the employer shall deduct appropriate taxes on it.

It shall remain your responsibility to claim deduction for expenses against the tuition fee and declare the same in ITR 4.

Secondly as we have already mentioned before, the income earned from tuition is not other income. It constitutes professional fees.
