I would like to know whether a back dated tranfer can be made valid. I will be completing the first year of articleship on 15.08.2011 and as per the announcement of ICAI there is no restriction on tranfer in the first year of articleship. The talks with my principle regarding the transfer are going on and it will take time i.e. atleast 15 more days to convince him due to some issues. I dont mind serving him for this period and not getting any credit but just wanted to know whether once he gets convinced, will I have to take permission from the ICAI since after the first year only after showing proper reasons as mentioned in the rules the transfer will be permitted. Will it be possible that I show that since I had taken leaves for my exams the first year is not complete in the actual sense and therefore no permission from the ICAI is required.
