Tenancy Rights

This query is : Resolved

16 September 2010 Is it necessary that there must be a contract or agreement between the tenant or owner of house property for existence of tenancy rights ?

If a person living in a rented house property from last 20 years does he have tenancy right where there is no agreement or contract between him and owner?

As per my view Tenancy right is a self generated asset & it generates as soon as tenant occupies the property for which he is going to pay rent, it is no where written in the act that rent agreement or contract is necessary.

Please give your view points and if there is any case u can also refer that.

Thanks

02 August 2025 Great question on tenancy rights! Here's a detailed view:

---

### Is a written agreement necessary for tenancy rights?

**No, a written agreement is not strictly necessary** to establish tenancy rights.
Tenancy can be created **either by an express agreement (written or oral)** or by **implied conduct**, such as the tenant paying rent and the landlord accepting it.

---

### What if a person has been living in a property for 20 years without any formal agreement?

* If the tenant has been **continuously occupying the property and paying rent**, tenancy rights can be recognized even without a written contract.
* Such tenancy is often considered a **“periodic tenancy” or “tenancy at will”**, depending on local tenancy laws.
* The tenant is entitled to protections under relevant Rent Control Acts or Transfer of Property Act provisions (like Section 5 of the Transfer of Property Act, which defines tenancy).

---

### Your view is largely correct:

* **Tenancy rights arise from occupation + payment of rent** (even if informal).
* Rent agreement or contract is **not a mandatory condition** for tenancy rights to exist.

---

### Relevant case law:

* **Kedar Nath Singh v. Union of India (1962)**: It emphasized that tenancy rights can be established by payment and acceptance of rent, even without a written agreement.
* **Sunder Lal v. MCD (Delhi HC)**: The court recognized tenancy based on conduct and payment of rent despite no written lease.

---

### Summary:

* No written agreement needed to create tenancy.
* Long-term occupation + rent payment generally establishes tenancy rights.
* Tenant can seek protection against eviction under Rent Control laws.
