My employer have not filed TDS return and not issued form 16 to me. now i am to claim TDS refund,how can i.

without TDS return filing, you won't get the automatic credit. I would suggest that you first file your return regardless of the tax credit being reflected in Form 26AS or not. Inform your employer that you are filing such a return and therefore he should file his TDS return asap. If that doesn't work, file a complaint with the jurisdictional AO and TDS AO stating the facts of the case including proof of tax deduction.

My accountant told me TDS Return is not compulsory,he filed his ITR by an advocate with help of form 16(manual).
