tds deduction on salary

23 June 2010 dear sir

we are the auth. distributor of aircel ltd and aircel ltd has asked to keep merchandisers on their behalf and aircel will pay their salary on monthly basis.

we have subdealer of aircel ltd. and aircel asked to keep a merchandiser on the behalf of the company to subdealer.
now the my querry is that should deduct tds while paying salary to subdealer against merchandiser as we firslty receive the whole salary of all merchandisers from aircel ltd.

23 June 2010 You need to tell what is the nature of agreement with Aircel and how this payment adjusted with the Aircel

there is verbal consent over the salary payment of merchandisers as aircel has asked us to keep merchandiser at our point (our dealership point) and our subdealer point and promise to pay the merchandisers salary on monthly basis thru stock transfer equilent to salary of all merchandiser

24 June 2010 further, aircel on monthly basis ask us to raise a bill for merchandiser's salary payment and we raises it with service tax on basic value get the paymement as stock included service tax, but aircel do not deduct any tds over this payment.
