18 February 2010 a aop has not deducted tds since last 3 yrs from civil contractors payment on the ground that the contractor had filed his return of income incorporating the payment recd from aop. whether this will absolve the aop from tds liability?

18 February 2010 No, you have to pay TDS, the effect of non payment of TDS income tax officer disallowed civil contractors payment as expenses.

19 February 2010 If he has paid the tax, your liability is relieved

26 February 2010 you must deduct TDS otherwise payment to contractor would be disallowed. if contractor had paid tax then ur liability relieved. but to be on safe side, u must deduct TDS.
