Please let me know whether cess would be applicable on tds w.e.f 01.10.2009 as we deduct tds on payments to contractors @2% + cess @3% as a whole 2.06% ?

30 September 2009 Surchage & cess are not applicable from 1.10.2009. The date is to decide the applicability of TDS provision & not the payment of TDS to govt. account.

For eg : TDS for the month of Sept 09, due date of deposit the tds will be 07-Oct. In such case u need to pay the tds along with surcharge & cess. Now TDS deducted for the month of oct 09 needs to be paid without surcharge & cess.

There is a gross misconception that Surcharge & Edu. Cess has been removed, so far as TDS is concerned w.e.f. 01.10.09.

A reading of the budget makes it amply clear that such a levy has been removed w.e.f. 01.04.2009.
