23 January 2009 Whether TDS will be deducting on Payment made to Foreigner Party ?

If yes how will we submit a tds return his PAN is Match with over Indian PAN

23 January 2009 as per rule 40(a) any payment made outside indian would liable for deduction of TDS otherwise it would not allowable for deduction.

2. while filing TDS return u have to give only 90% paries PAN . so one/ two paties pan no. is not there then also return would be accepted.

3. another option is that u instruct that party to apply for the PAN in india as non resident status.
