WE ARE WHOLESALE DEALERS IN HOSIERY OUR TURNOVER ID 1 CROR . DURING THE F.Y. 2010-11 WE PAID FREIGHT OD RS. 85000/- . TRANSPORT COMPANY HAS NOT LAVIED ANY SERVICE TAX . 1) SHOULD WE HAVE TO PAY SERVICE TAX . IS YES REGISTRATION NECCESSARY PLS. ADVISE . THNKS IN ADVANCE

03 July 2011 Since your turnover exceeds the minimum exempted turnover as per service tax, you are required to get yourself registered under Service Tax.

The input credit for Service Tax is allowed and adjusted against paid and collected by the company. In your case you have not paid it as the transporter has not charged Service Tax to you. It might be possible that the turnover of the transporter who has transported your goods is below the minimum taxable limit or the transporter might not be aware about the Service Tax. Kindly check with the transporter although it is not your duty to do so.
