12 January 2009 Dear Sir,

I heard that Madras High Court put Stay on Levying Service Tax on Construction of Residential Apartments.

Is it Really Happens ?

If so shall we go further with out paying the Service Tax on Construction of residential Apartments based on the Stay

Pls. Advice.

12 January 2009 No idea about the referred case. Even if it is true construction of flats attracts service tax u/s 65(105)(zzzza)of The Finance Act,1994 under works contract category.

13 January 2009 Even if Stay had been obtained, I am afraid, it may be applicalbe only for the one who obtained it. However, trace the Order for a critical study to decide further course of action
