Service tax for civl contractors

22 November 2011 im civil contractor suppose i given my bill of Rs.1000 to my client under commercial construction in my knowledge the two ways in which i can pay service tax ie.

67% of material i.e. 670
33% of labour part i.e.330 i paid 10.3% service tax on labour that is services First can i avail input credit on this service

or
i paid 4% on total value of bill can i avail input credit on this amount.

Some one say that i can only claim input credit if i pay 10.3% of labour and not if i deposited 4% on whole amount, please clerify...

22 November 2011 Based on the fact of the case civil contractor will fall either under commercial or industrial construction services u/s 65(105)(zzd) or fall under works contract u/s 65(105)(zzzza).
