servce tax on renting

15 March 2010 the property in delhi was let out on rent of Rs 200000/- per month in June 2009 i.e. after decision of Delhi High Court hence no service tax is charged from tenant, no registration in service tax dept was applied.

now after the budget do I need to pay the interest also, my submission is that service was neither collected nor paid in view of judgment of Delhi HC

15 March 2010 You need to collect and pay service tax in view of the clarification in the budget which has retrospective effect.

Moreover, the Delhi HC judgement was being contested in the supreme court and the effect of the order stayed by the Supreme Court.
