23 July 2025 There is **no blanket immunity** from scrutiny proceedings solely because an assessee is a **senior citizen**. However, there **was some confusion in the past** due to **press releases and internal instructions** issued by the CBDT regarding **non-business senior citizens with low income**.

Here’s a detailed clarification:

---

### ✅ Relevant Circulars / Instructions (Historical Reference)

#### 🟢 **CBDT Instruction / Clarification (2011–12):**

* **Source**: *Press Note / Internal instruction* (not a formal circular)
* **Year**: Around 2011–12
* **Context**: Some field officers were advised not to select **small salaried taxpayers, pensioners, or senior citizens** with **low-risk profiles** for scrutiny under **Computer Aided Scrutiny Selection (CASS)**.

🔸 **Important**:
This was **not an exemption**, but only an **administrative instruction** to avoid unnecessary scrutiny in low-risk cases.

---

### 🚫 No Circular Grants Blanket Exemption

There is **no circular or notification** from CBDT that **legally bars Income Tax scrutiny** for senior citizens. **Section 143(2)** (which deals with scrutiny) **applies equally** to all assesses, regardless of age.

---

### ✅ Exemption from Advance Tax

However, **Section 207 of the Income Tax Act** **does exempt resident senior citizens** (who do **not have business or professional income**) from paying **advance tax**.

---

### ✅ Summary

| Query | Clarification |
| ----------------------------------------------------------------------------- | -------------------------------------------------------------------------------------------------------------- |
| Is there a circular fully exempting senior citizens from scrutiny? | ❌ No such circular exists. |
| Was there any instruction to avoid scrutiny in low-risk senior citizen cases? | ✅ Yes, internal CBDT instruction (around 2011–12) advised avoiding scrutiny in low-risk cases like pensioners. |
| Can senior citizens be selected for scrutiny? | ✅ Yes, if flagged under risk-based parameters, they can be scrutinized. |
| Is there any exemption senior citizens enjoy in taxation? | ✅ Exemption from advance tax under Sec 207 if no business income. Higher basic exemption limit too. |

---

If you're dealing with a real case where a senior citizen has received a scrutiny notice, I can help you draft a suitable **response or representation** as well.
