05 June 2012 THE COMPANY IS PAYING RS. 22000/- & 18000/- TO SAME TRANSPORTER IN SAME DAY, WHEN TAKEN THIS AMOUNT FOR DISALLOWED, COMPANY SAYING THAT THE RESPECTIVE PAYMENT IS MADE TO SAME TRANSPORTER'S DIFFERENT DRIVER & FOR DIFFERENT TRUCK HIRING CHARGES

IS THE SECTION 40A(3) IS APPLICABLE ON THAT OR NOT?

PLZ GIVE ANSWER AS EARLY AS POSSIBLE & ALSO SUGGEST ANY NOTIFICATION OR CIRCULAR IN THIS REGARDS

05 June 2012 U shall require to review the terms of the contract.. is your contract with the company or the drivers directly.. if the contract is with the company, no matter whom he pays latter.. you make the payment to the company and hence 40 A(3) provisions shall attract..
