12 September 2012 Notice for default of mandatory appointment of company secretary has been issued where as client has not made any efforts for appointing the same.
So now wht should be the reply to registrar for avoiding the fine of 500 per day
If anybody has advertisement format for appointing the CS please provide me

13 September 2012 Yes the company has to proove that inspite of making efforts it has failed to appoint a CS. Advertisement is a very good proof for this.

13 September 2012 Ankitji,

Company can show that it has made 2-3 advertisement in newspapers and chartered secretary however, failed to appoint any suitable candidate for the post of comapny secretary. Therefore, due to shortage of company secretary we are failed to appoint.

If it is willful default then penalty is to be born.

Otherwise appoint a Company Secretary and reply the notice that the company secretary has been appointed attach form 32 the notice will be resolved.
