Reverse charge mechanism- manpower services

01 May 2014 Dear Sir,

My client is a body corporate and getting services of Manpower Agency, A Firm .
Now that agency is charging 12.36 % service tax on Bill.

My question is that whether still my Liability Stand though government is not at loss.As i have to pay 75 % of total service tax amount as per RCM .

Please Clearify

01 May 2014 Service Provider constitution → Ltd Company can u pay 100% on gross (12.36%)

Service Provider constitution →Firm can u pay 25% on gross (3.09%)

01 May 2014 provider & receiver both share can pay their share of ration

not provider pay 100% can not department accepted and ask ur postion tax liability

rcm main aim catches evaders.

so u pay ur ratio
