Receiving money as a gift from your uncle for your sister's marriage:
Definition of 'Relative' under Income Tax Act: For the purpose of tax exemption on gifts, the Income Tax Act (Section 56(2)(x)) exempts gifts received from specified relatives. An uncle is considered a "relative," so gifts from him are exempt from tax. Tax Implication: Since the amount is a gift from your uncle, it is fully exempt from income tax under Indian tax laws, irrespective of the amount. Receiving the Amount in Your Account vs Sister's Account: Ideally, it’s simpler and cleaner if the money is received directly in your sister’s bank account for transparency. Receiving in your account is also allowed, but you should be able to prove that the money was gifted for your sister’s marriage (a close relative’s marriage is exempt from tax). Documentation: It’s advisable to keep a simple gift deed or a declaration stating that the amount is a gift from your uncle for your sister’s marriage. Keep bank statements and transfer receipts to establish the source and nature of funds. Why the consultant might be concerned: Sometimes, receiving large sums without clear documentation may trigger scrutiny by tax authorities. If you receive the amount in your account and spend it on something unrelated or don’t document it properly, it might raise questions. Conclusion: You do not have to pay any tax on this gift. Proper documentation and transparent banking transactions will help avoid any issues. Receiving directly in your sister’s account is simpler, but if you receive it in your account, just keep the paperwork in order.
