28 January 2012 Assessee' income under the head salary.

During the course of assessment preceding assessee could not providing supporting u/s 80 D & 80DD.
On the above surcumstances disallowed duction alose impose panelty u/s 271(1)(C)or not.

28 January 2012 Can be disallowed for want of proof. Penalty can't be levied under section 271(1)(c) since it can't be treated as concealment rather furnishing inaccurate particulars of income.
