M ABOUT TO COMPLETE MY ARTICLESHIP IN COMING JAN, BUT MY SIR IS TRYING TO EXTEND IT FOR 6 MONTHS FOR NO REASON, ACTUALLY THE MATTER IS THAT NO NEW ARTICLE HV JOINED OUR OFF NOR ANY OTHER NEW STAFF IS COMING SO HE IS IN A PROBLEM. I HV SAID THAT ILL EXTEND IT TILL MARCH (I.E 2MONTHS AFTER COMPLETION) BUT NOT MORE THAN IT, BUT HE IS NOT READY FOR THIS. IF ALL OUR ARTICLESHIP RULES ARE TAKEN INTO CONSIDERATION THEN I CAN TAKE LEAVE FOR MORE THAN 3 MONTHS,(I.E THERE WAS NO NEED OF ME GOIN TO OFF FROM NOV-10 TO JAN 11) SO IN THIS SENCE I HV EXCEEDED MY ARTICLE SHIP DURATION.
SO HERE I WANNA KNOW HOW A STRICT ACTION CAN BE TAKEN ON SUCH CA'S WITH THE HELP OF OUR INSTITUTE, N M PLANNING OF NOT GOIN TO OFF UNLESS THIS MATTER IS SORTED OUT.
SO PLZ TELL ME HOW SHOULD I SOLVE THIS PROBLEM.
HE HAS CREATED A FAVORITISM IN OFF, N IS TRYING TO GET MORE FROM PERSON WHO DOES THE WORK. UNNECESSARILY HE IS EXTENDING, SO A STRICT ACTION IS NEEDED ON SUCH CA'S WHO TRY GET THEIR WORK DONE AT THE COST OF STUDENTS FUTURE..

20 July 2025 I totally understand your frustration — this situation isn’t fair and can be quite stressful.

Here’s what you need to know and can do regarding articleship extension without valid reason:

1. ICAI Rules on Articleship Extension
Articleship should normally be for 3 years (36 months).
Leave taken beyond permitted limits can justify extension, but extension cannot be forced without valid reasons.
If you have completed your 3 years (considering leaves), your principal cannot unilaterally extend your articleship.
2. Your Rights as an Article Student
You are entitled to complete your training in the stipulated period.
If you have exceeded allowed leaves, extension is justified; otherwise, no.
The principal cannot compel you to continue beyond that without your consent.
You can refuse to attend office beyond your completion date if extension is not agreed.
3. Steps to Resolve This
Discuss calmly with your principal and explain the rules (refer ICAI guidelines on leave and extension).
If he insists on extension without valid reason, write a formal email or letter stating your position.
Approach the Regional ICAI office or your local branch of ICAI:
File a written complaint about unfair treatment or coercion.
The ICAI has grievance redressal mechanisms for such issues.
Keep all communication documented — emails, letters, and any replies.
Seek advice from seniors or mentors in the CA community.
4. ICAI Action Against Unfair Practices
ICAI can investigate complaints against members (your principal) for professional misconduct.
If proven, they can take disciplinary action.
Your principal can also be held responsible for violating articleship norms.
5. If You Plan to Stop Attending Office
Give a written notice about your articleship completion date.
Inform ICAI about the issue.
Make sure to get your Form 108 (completion certificate) signed, or if withheld, escalate it to ICAI.
