15 November 2012 Dear Members,

XYZ Private limited (Company is in Bangalore) which is a subsidiary Company of a US Company, whose main object is developing software and selling the same to its parent company.

Kindly let me know whether VAT registration is required for this Company. If so for what purpose? Pl enlighten me with the applicable provisions.

15 November 2012 VAT Registration not required in your case since the developing software purely related to service nature.

Incase of readymade software sale then VAT registration required for sale of software will attract VAT.

16 November 2012 VAT registration is required even for exporters of software.As software is taxable while exporting the same you can claim refund of the VAT paid to vendors on such purchases...MJK
