Query regarding filing of adt 1

28 July 2015 Dear Professional,

As forms for Annual Filling are not available and in case the AGM of the Company held in month of JULY then, form ADT-1 has to be filed within 15 days from the date of AGM.

So my query is:

1. Can we file form ADT-1 before filling of Annual Filling forms (which are pending from MCA side).
2. Non filing of ADT-1 within 15 days from the date of AGM attract penalty and non compliance as well also MCA has not provided any relaxation in connection.

Kindly suggest the action to be taken.

Yes, you have to file Form ADT-1 within 15 days from the date of AGM (irrespective of filing of Annual Filings forms). If due date is gone, you will have to pay additional fees.
