Professional Tax on Stipend (For Gujarat)

(For Gujarat State)

Whether professional Tax from the stipend paid to the trainee is required to be deducted?

(Note: it is More than 3000/- permonth)

Please let me know as i have not find clarification about the stipend in the PT Act.

24 June 2008 The stipend paid is not liable to profession tax,provided that, there is no employer- employee relationship with trainees.

I am not talking about specific training but....

Ours company has > 1200 employee and We employing persons as trainee for first 6 months and then take them on the permanent scale....

In above case whether emplyer - employee relation is established or not???

I believe that PT shall be deducted because PT is on salary whatever be the name of salary whether it is Stipend or Wages or anything.....
