09 August 2024 The Payment of Bonus Act, 1965, is a law in India that mandates the payment of bonus to employees in establishments based on certain conditions. Hereโ€™s how it applies in your scenario:

### **Key Provisions of the Payment of Bonus Act:**

1. **Applicability:**
- **Threshold of Employees**: The Act applies to establishments with **20 or more employees**. If an establishment has 20 or more employees during the financial year, it is required to comply with the Act.
- **Computation of Bonus**: The bonus is computed based on the earnings and is generally payable if the establishment has a surplus. The Act mandates payment of a minimum bonus of 8.33% of the salary or wages earned by the employee during the accounting year.

2. **Change in Employee Strength:**
- **Reduction in Employees**: If an establishment has more than 20 employees in a financial year and subsequently reduces its workforce to less than 20, the Act still applies for the period when the establishment had 20 or more employees.
- **Ongoing Obligation**: The obligation to pay bonus for the financial year when the number of employees was 20 or more continues even if the number of employees falls below 20 in subsequent years.

### **Implications in Your Case:**

1. **Payment of Bonus for the Previous Year:**
- **Liability to Pay**: Since the establishment had more than 20 employees during the relevant financial year, it is liable to pay bonus for that year as per the provisions of the Act, regardless of the current number of employees.

2. **Reduction in Employees:**
- **Future Applicability**: If the number of employees falls below 20 in subsequent years, the establishment may not be liable for bonus payments for those years, as the Act does not apply to establishments with less than 20 employees.

3. **Legal Compliance:**
- **Payment for Previous Years**: Ensure that bonus payments are made in accordance with the Act for the period when the establishment had 20 or more employees. Failure to do so can result in legal consequences or disputes.

### **Key Points to Remember:**

- **Bonus for Previous Years**: The establishment must fulfill its obligation to pay bonus for any financial year during which it had 20 or more employees.
- **Current and Future Compliance**: For the current and future financial years, if the number of employees is below 20, the establishment may not be obligated to pay bonus.

### **Steps to Ensure Compliance:**

1. **Verify Employee Count**: Ensure accurate records of employee strength to determine applicability of the Act.
2. **Make Payments**: Calculate and disburse bonus payments as required for the years when the number of employees was 20 or more.
3. **Consult Legal Experts**: If there are complexities or disputes, consult legal or HR professionals to ensure compliance with the Act.

### **Summary:**

- **Previous Year Liability**: The establishment is liable to pay bonus for the year when it had 20 or more employees.
- **Reduction in Employees**: For subsequent years with fewer than 20 employees, the Act may not apply.

Ensure all obligations under the Payment of Bonus Act are met for the relevant years and consult professionals for specific legal advice.
