Pan card not submitted by employee

20 August 2014 Dear experts
one of our employee had not submitted his pan card. he is drawing a salary of rs 30000. we deducted his income tax at the rate of 20%. and sumbit his tax.now we came to know that he got his pan card few months back.he is asking for form 16 for fy 13-14.
pls advice urgently if we are correct in deducting Tds and should we issue him form 16??

20 August 2014 1. Tax is always to be deducted as per calculations and rules whether or not u did not get his PAN card .Also deposit the TDS to Tax authority as per qtly schedule .

2. Form -16: Every employer is supposed to issue Form -16 to all their employees and u cannot deny anyone . Now u can ask him to produce copy of PAN card before issue to mention his pan NO in his Form-16.
