notice of Demand

AO has not served notice of demand to assessee, and taking recovery proceeding. In actuallity assessee is in default ie. he has not paid complete tax. how to overcome?

Dear Lucky,
According to section 156, Failure to serve Notice of Demand renders the recovery proceedings invalid. Their is a famous Case Law for this what I rembember, it is SRI MOHAN WALI Vs CIT
