Liability of Service Tax

This query is : Resolved

24 March 2009 A service Provider who had provided Taxable service in 2007, can claim the amount of Service Tax from service Receipint if not claimed in 2007.
If so, whether Service receipint is liable to pay service Tax in 2009 or can deny the liability of service Tax now

24 March 2009 It all depends on the mutual understanding with the service provider.

If you pay in 2009 as a recepient you can enjoy the service tax credit.

However the service provider will need to raise a Invoice.

There is no supplimentary invoice provision in service tax, that means he has to raise invoice afresh, quoting relevance of the previous invoices

The above clarification is NOT provided as a legal opinion. Individual organizations are encouraged to seek professional consultancy from their respective lawyers.
