01 June 2011 Dear Sir/ Madam

Example: Mr A died during the financial yr 2009-10.

Ques 1:- Is his income for the fin yr 2009-10 is liable to be taxed in his hand for the Ass Yr 2010-11?

Ques 2:- If any income relating to him, TDS is deducted from it and the TDS certificate has also been issued in his name, then whether in the ass yr 2011-12 also income tax return is to be filed in his name?

Sir Kindly advice whether the return is to be filed in the name of Mr A or his legal heir.

Kindly advice asap.

Yes, His legal representative will file his return.

Ques 2:- If any income relating to him, TDS is deducted from it and the TDS certificate has also been issued in his name, then whether in the ass yr 2011-12 also income tax return is to be filed in his name?
Ans : The Tax can be refunded on his account provided the return is filed showing the income on which tax has been deducted.
