Hra exemption u/s 10

16 February 2013 Respected Sir,

I am office assistant in Govt. office and dealing in income tax matter.

1. one of our employee have claim HRA exemption in following conditions:-

1. He has own name house in working place and also has his wife name house in working place.
2. The distance between himself and his wife name house approximately 4 Kms.
3. He has submitted a rent receipt from his wife.
4. He shows income from house property as himself name house rented out.
5. he is physically fit for duties.

Can he eligible for HRA exemption under section 10 of IT Act. If not which action will be taken upon him as per IT rules.

16 February 2013 Yes he is eligible since he is living in a rented house whether of Wife or any body's
Since the house is in the name of Wife and the wife is also separately showing the rent income in her ITR Also the other house rent income is being shown by the employee in his ITR therefore the same is in accordance with the provision of Income Tax.
