08 January 2014 Hello everyone, i am a salaried person and having some doubt on HRA exemption, need help for some points

1. Can rent paid to parents
2. is it mandatory to have rent agreement if rent paid to parents
3. If either of parent is a govt employee and
children paying rent in cash for the govt flat where they live with the parents, is it legal???
4. What if parents do not show any income from other sources

09 January 2014 1. yes you can pay rent to parents..

2.. agreement is compulsory with respect to stamp duty act...income tax can do without the agreement

3. it may land your parents in problem with regards to their service rules as this may be considered as sub-letting which is generally not permitted

4. if parents dont show such income, then it is concealing income and income tax penalties can be levied..
