Holding of COP

Hi Friends,
My Friend is also CA wants to apply for COP, but he holding IEC Code from last 6 months(Import Export Code) for export of goods outside the country (Completed Article 3years back). From the date taking the IEC code till now he has not transacted any business or has now intention to do any business of export.
Whether he can apply for COP by Intimating the fact of holding the IEC code or he has to surrender the IEC No. Please clarify

If he has no intention to export/import better surrender IEC and apply for COP.

For practising COP is needed,But he cannt engaged with his business without the permission from the Institute.If the institute is willing to permitt then no need to surrender his IEC CODE, ELSE HAVE TO SURRENDER THE CODE.
