If the employer does not pays the employees contribution to ESI within due date. Will it be permanently disallowed u/s 36(1)(va)

Yes... The law says you can keep money of the govt and afterwards pay interest and get deduction but u cannot keep money collected from employee and get deduction of the same on delayed payment.
