Condonation of delay for filing appeal

sir, one of my client has faced search. During the assessment proceedings u/s 153 some additions have been made on agreed basis with the condition of no penalty. for which assessee has not filed appeal against order but IT dept. has imposed penalty on addition. We have filed appeal before CIT against penalty order. Now can we file appeal against assessment order u/s 153? plz help me in this matter

Appeal can be filed. If delayed, condonation petition shall also be filed along with appeal.
